Conveyancing is the legal process of transferring ownership of a property from vendor to purchaser. In Victoria and NSW, it includes reviewing the Contract of Sale and Section 32 Statement (in Victoria) or Vendor Disclosure documents (in NSW), conducting property searches, liaising with banks, and arranging settlement through PEXA.
You are not legally required to use one, but it is strongly recommended. A licensed conveyancer or solicitor ensures the contract complies with VIC or NSW legislation, identifies risks, explains special conditions, performs required searches, and manages settlement.
The typical timeframe is 30 – 60 days from exchange to settlement. However, the settlement timeframe is subject to negotiation between the vendor and purchaser.
Common searches include title and plan searches, council and water rates, land tax or land tax clearance, planning and zoning checks, strata reports for strata properties, and VicRoads or NSW Roads and Transport checks when relevant. These searches help you understand restrictions, liabilities, and risks that may affect the property.
The deposit is usually paid at contract signing or exchange, typically 10 percent or sometimes 5 percent by negotiation. Stamp duty in NSW is due at the earlier of settlement or within three months of contract exchange. In Victoria, stamp duty is paid at settlement. First home buyer concessions or exemptions may apply in both states.

Settlement is usually completed electronically through PEXA. We coordinate with the other party and your bank to transfer funds, register the transfer, and discharge or register any mortgages. Once settlement is final, the purchaser becomes the legal owner and can collect the keys.
